Indiana Criminal Trespass Conviction Reversed for Banned Bar Patron on Sidewalk
An Indianapolis bar patron was removed by security for smoking and given a trespass warning.  He then returned and stood on the sidewalk directly in front of the bar. A police officer asked the man to leave several times, but he refused and stated that he was getting information because he was going to sue the bar. He was then arrested for criminal trespass, a Class A misdemeanor. The Indiana Court of Appeals reversed the criminal trespass conviction, because the defendant was on public sidewalk when he was arrested and not the bar’s property.
