Allen County Expungement Petition Entitled to Day in Court
A petition for expungement of criminal records that was denied by an Allen County judge has been reversed and remanded for further proceedings. The Indiana Court of Appeals determined that the Allen County court incorrectly denied the petition without first setting a hearing. The case solidifies that a petition for expungement cannot be denied without a hearing unless the petition either 1) does not meet the statute’s requirements or 2) makes statements that demonstrate the petitioner is not entitled to relief.

As of March 21, four Indiana counties have moved to e-filing: Hamilton County, Clark County, Harrison County, and Shelby County. Hamilton County Dealing Marijuana Conviction Reversed
A Hamilton County man’s convictions for dealing in marijuana and maintaining a common nuisance have been reversed. The Indiana Court of Appeals determined that the probable cause affidavit used to conduct a canine sniff of the man's property contained insufficient evidence. In addition, the Court determined that Hamilton County investigators recklessly ommitted important information from the probable cause affidavit.

State Police Conduct Sobriety Checkpoints for St. Patrick's Day
The Indiana State Police will be conducting sobriety checkpoints and roving saturation patrols in dozens of Indiana counties over the St. Patrick's Day holiday and into the weekend. Police will be aggressively targeting drivers for charges of Operating While Intoxicated, as well as citations for unrestrained motorists. Checkpoints will take place in Porter County, Clark County, Marion County, Miami County, Henry County, and St. Joseph County. After the checkpoints, several additional counties will be subject to "roving saturation patrols".
